Important Trade Notification
mandatory AES Filing - Enforced Compliance to Begin February 1, 2009
Dear Valued Customers:
On January 2, 2009, the U.S. Customs and Border Protection (CBP) published Guidelines for the Imposition and Mitigation of Civil Penalties for Failure to Comply with the Foreign Trade Regulations (FTR) in 15 CFR Part 30. The document provides assessment and mitigation guidelines for violations of the FTR published by the Census Bureau on June 2, 2008.
The FTR requires mandatory filing of export information through the Automated Export System (AES) or AESDirect for all shipments where export information is required. The penalty provisions that will be administered by the CBP are set forth in sections 30.71 and 30.72 of the FTR.
The guidelines are effective on February 1, 2009 for violations occurring on or after February 1, 2009.
Please Note: To ensure cargo is loaded to the intended vessel, ITN number, post departure filing citation, or exemption citation must be provided to Sea Star Line one hour prior to the cargo in-gating. Carriers are prohibited from releasing any cargo to the vessel without the required filing information. Any container arriving to the terminal without this information runs the risk of not being loaded on the vessel.
