
Mandatory AES 24 Hour Ruling
Effective September 30, 2008

The U.S. Census Bureau issued the final rule to amend its regulations implementing provisions in the Foreign Relations Authorization Act. Specifically, the Census Bureau is requiring mandatory filing of export information through the Automated Export System (AES) or through AESDirect for all shipments where a Shipper's Export Declaration (SED) is required.
This rule went into effect July 2, 2008. Effective September 30, 2008 penalties will be assessed. Crowley will require compliance at all locations on this date.
Customers are required to provide the Carrier shipping instructions or bill of ladings containing the Internal Transaction Number (ITN) or exemption 24 hours prior to cargo loading the vessel.
September 4, 2008 The United States Department of Commerce issued an exemption on the filing time frame for Puerto Rico. For cargo loading from the United States to Puerto Rico or Puerto Rico to the United States, the shipper or agent must file the SED and provide the Carrier the ITN or exemption prior to vessel departure.
The Electronic Export information (EEI) is used for compiling the official U.S. export statistics for the United States and for export control purposes. The regulatory provisions for preparing and filing the EEI are contained in the Foreign Trade Regulations (FTR), Title 15 Code of Federal Regulations (CFR) Part 30.
As of September 30, 2008 Crowley will commence enforcement of the cut-offs listed on the following matrix for export documentation and cargo delivery.
Export documents (shipping instructions, master b/l's etc) must clearly indicate the ITN number (Internal Transaction Number) or exemption legend. Failure to comply will result in shipment delays. A $75 charge will also be added to the bill of lading for any cargo that has to be held for lack of documentation.
For all customers which Crowley Logistics acts as the agent and files the SED, additional cutoff information has been added to the matrix.
